1.2 The Privacy Policy complements the Terms of Use applicable to the Website. This privacy policy forms an integral part of these Terms of Use. The Terms of Use and this Privacy Policy apply during the entire time of visiting and using the Website.
1.3 Before contacting us, you must state that you have read, understood and agree to this privacy policy. In doing so, you expressly agree that ticking a fill-in box counts as your informed, specific, free and complete consent such as a signature to agree to the contractual documents.
1.4 If you do not understand this privacy policy or any part of it and/or do not agree with one or more of its provisions, please do not use the Website. In this case, you can always contact us using the contact details indicated above.

2. What data do we collect and for what purposes are these data used?
When using the Website, different types of information are collected and used for various purposes. Below you will find an overview thereof as well as the legal basis on the basis of which we collect this data. Naturally, the information in question is only processed insofar as you fall within a certain category of data processing.
2.1 For some processing you have given your own consent. In certain circumstances, you may voluntarily provide information yourself, for example to request information.
(a) For example, you can contact us via the contact section on our Website. In doing so, you can provide the following information: name, company, company website, e-mail, telephone, subject and message. Use of this function is of course not mandatory.
(b) You can also voluntarily subscribe to our newsletter. For this, you must give separate and explicit consent. You can unsubscribe to this at any time. This can also be done on simple request by e-mail or at the bottom of each mailing via the 'opt out' choice.
(c) You can also contact us in the context of a published vacancy. In doing so, you obviously provide us with the details you wish to give.
(d) You may also be asked for permission to process certain data in the context of organizing additional promotional campaigns, in which case you will of course decide whether you wish to participate.
2.2 Some processing we may carry out in the legitimate interest of our company. In some cases, no consent was given for the processing of your data, but we still believe we have an interest in processing personal data that outweighs individual privacy rights.
(a) Naturally, we collect general and statistical data (e.g. IP address, referral pages, date and time of visit, duration of visit, etc.) on the use of our Website, e.g. in order to detect errors, but also in order to optimise the use of our Website and to generate aggregated and statistical data.
(b) We also use personal data for purposes of researching our information offered via the Website and optimising our Website. We ensure that this data has the least possible impact on your privacy and take all necessary measures to protect it.
3. What data do we share with third parties?
3.1 We wish to protect your privacy as much as possible. In that context, we wish to limit the sharing of your data with third parties to a minimum as follows.
3.2 Within the company, there are contractual agreements in place which stipulate that access to personal data is limited to those persons who need to have access to it because of their function. Moreover, we have strict internal guidelines within our company that relate to the security and confidentiality of data, including your personal data.
3.3 In addition, as a general rule, the company never passes on the personal data obtained to third parties, other than as stipulated in this privacy policy as follows:
(a)With competent authorities authorised to request that information or to whom we must disclose information, or when legally required or as a result of legal proceedings or litigation;
(b) In addition, we may disclose your information if we determine it is reasonably necessary to enforce our terms and conditions or to protect our business or users;
(c) We may share your data with third-party service providers acting as "processors" on behalf of our company, e.g. an email program, a CRM package, etc. In this case, we will always ensure that we obtain the necessary (contractual) guarantees that the service provider has taken appropriate privacy measures (including any transfer of data to countries outside the European Economic Area);
(d) At your request, for example when you require us to transfer your data to a third party (e.g. a product manufacturer);
(e) With companies within our corporate group or our shareholders when necessary to fulfil your specific request;
(f) In addition, in the event of a reorganisation, merger or sale, we may transfer any personal data we collect to the relevant third party.
3.4 We generally do not intend to transfer personal data to other third persons nor to transfer personal data to countries outside the European Economic Area; however, should this happen, please refer to clause 3.3(c) above and we will ensure to take appropriate safeguards.
3.5 The Website provides some links to third-party websites or platforms (e.g. social media platforms). Please note that when you click on these links, the terms and conditions, privacy and other contractual provisions of those third parties will apply. In any event, we recommend that you read these thoroughly. We take no responsibility in this regard and you enter/use this website and/or platforms at your own risk.
4. The use of cookies and other technologies
4.1 During a visit to the Website, cookies or other tracking tools may be placed on your device. A cookie is a text file placed by a website's server in your computer's browser or on your mobile device when you consult a website.
4.2 The Cookie Statement provides more detailed explanations about our use of cookies (e.g. which cookies are used, their purposes, how to delete them, etc.).
5. Protection of personal data
5.1 We take the security of your personal data very seriously. We secure your personal data during transmission and "at rest" (at rest). If your personal data is kept at the company, we use computer systems with restricted access in locations with physical security measures.
6. Integrity and retention period of personal data
6.1 If you wish to update your data, you can always contact us (see also article7 of this privacy policy).
6.2 We will retain your personal data for the period necessary to fulfil the purposes described in this privacy policy, unless a longer retention period is required or permitted by law.
6.3 Data for which you have given your own consent as well as those processed on the basis of the legitimate interests of our company will be deleted periodically, taking into account the concrete circumstances and the applicable statutes of limitation.
7. Rights to which you are entitled
7.1 The privacy legislation stipulates a number of legal rights to which you are entitled as an individual, under certain circumstances and conditions. More specifically, these include a right to access and rectify or erase personal data, as well as the right to object to processing and the right to data portability.
7.2 Our company and its employees take all privacy enquiries seriously and will deal with them promptly. In order to streamline this process, we ask you to email us at info@onpoint.fund. when requesting the exercise of your rights. You may also contact us by any other means. We do reserve the right to verify the identity of the requester, as we obviously need to protect the privacy of third parties as well!
7.3 In certain cases, we may refuse requests, for example when they are very unclear or suspicious, compromise the privacy of others, are extremely impractical, etc. In doing so, we always act in line with prevailing legislation.
7.4 Please note that for those cases where we process your personal data on the basis of your consent, you have the right to withdraw the consent at any time, but without prejudice to the lawfulness of the processing on the basis of the consent before its withdrawal.
7.5 In addition, you have the right to lodge a complaint with a supervisory authority at any time. In Belgium, this is the Data Protection Authority (see www.gegevensbeschermingsautoriteit.be; address: Drukpersstraat 35, 1000 Brussels; Telephone: +32 (0)2 274 48 00; E:contact@apd-gba.be ). However, we naturally always prefer to try to find a solution first!
